These terms and conditions apply to the RMF Soccer Camp named on the Guest Reservation and Payment Form (the \u201cRMF Soccer Camp\u201d) and the program for this RMF Soccer Camp.<\/p><p><strong><u>Reservations<\/u><\/strong>: A completed payment fee per participant, depending on the program chosen (except when otherwise noted in writing by us) and a completed Reservation Form (\u201cReservation Form\u201d) are required with this Participant Agreement to reserve space for RMF Soccer Camp. All prices are in Canadian Dollars. Except as expressly stated in the brochure, you are solely responsible for any RMF Soccer Camp-related costs that you incur.<\/p><p><strong><u>Client Cancellation &amp; Refund Policy<\/u><\/strong><u>:<\/u>\u00a0If you choose to cancel your registration, we must receive written notice of said cancellation either via certified mail, overnight courier, or e-mail sent to info@rmfsoccercampscanada.com<em>\u00a0<\/em>(with confirmation of receipt from us), and you shall be subject to the following cancellation fee:<\/p><ul><li>If we receive a written notice prior 60 days of the camp date, the organization will retain CAD $100.00 as a compensation for the registration expenses.<\/li><li>If we receive a written notice between 60-30 days of the camp date, the organization will retain 50% of the payment fee paid.<\/li><li>If we receive a written notice of cancelation within 30 days of the camp date, there will be no refunds of the amount paid for the FRM Soccer Camps.<\/li><li>If the participant simply does not show up to the camp, there will be no refunds for the amount paid.<\/li><\/ul><p><strong><u>Cancellation or Substitution<\/u><\/strong>: We may cancel any RMF Soccer Camp at any time for any reason, including without limitation if we deem the number of participants signed up for a given RMF Soccer Camp to be insufficient to operate such RMF Soccer Camp. We may also change the current location to a different one within 20 miles radius due to factors beyond our control. We will make commercially reasonable efforts to keep the schedule and location as it has been published; however, the final schedule may vary due to factors beyond our control. We may in our sole discretion substitute services or goods of similar quality for any service or good stated in the schedule. If the RMF Soccer Camp is cancelled, our liability is limited to a full refund of your deposits and RMF Soccer Camp price, and we will not be liable for any other costs, damages, or refunds of any kind for any loss, delay, inconvenience, disappointment, or expense whatsoever in such circumstances. If for reasons beyond our control, a RMF Soccer Camp in progress must be interrupted or cancelled, we will in good faith consider refunding a portion of the RMF Soccer Camp Price depending on our actual costs incurred compared to the RMF Soccer Camp as originally contemplated.<\/p><p><strong><u>Certification of Participant\u2019s Health; Responsibility to Inform Operator of Disabilities or Pregnancy:<\/u><\/strong>\u00a0By signing below and\/or tendering any portion of the RMF Soccer Camp Price to us, you certify that you do not have any condition or disability that would create a hazard for you or others participating in the RMF Soccer Camp. You agree to inform us via certified mail or e-mail sent to\u00a0<em><strong>info@rmfsoccercampscanada.com\u00a0<\/strong><\/em>(with confirmation of receipt thereof from us) at the time you tender your first payment of the RMF Soccer Camp Fee (or at such later time when you become aware of such a condition) of any existing physical or mental illness, disability, pregnancy or any other condition for which you may require medical attention or special accommodation during the RMF Soccer Camp. We make no guarantee to be able to accommodate you for such condition during the RMF Soccer Camp, and we make no representations or warranties regarding special accommodations or handicap accessibility on the RMF Soccer Camp.<\/p><p><strong><u>Athletics Release:<\/u><\/strong><strong>\u00a0<\/strong>You hereby acknowledge that playing or practicing soccer is a potentially hazardous activity. You agree that you are voluntarily entering and assuming all risks associated with participating in those activities, including but not limited to falls, contacts with other participants, the effects of weather including heat and or humidity, and the conditions of the training grounds and facilities, all risks being understood and appreciated by you. Having read this waiver, and knowing these facts, and in consideration of Kaptiva Sports\u2019 acceptance of this application, you hereby waive and release the Kaptiva Sports Inc. and its representatives from all claims and liabilities of any kind arising out of your participation in soccer playing, practicing, or training.<\/p><p><strong><u>Responsibility\/Liabilities:<\/u><\/strong>\u00a0We act only in the capacity of agent for providing services or goods in connection with the RMF Soccer Camp (the Suppliers\u201d), camp operators, and providers of entertainment. We assume no responsibility for any personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be occasioned either by reason (1) any act or omission of any of the Suppliers (2) any matter beyond our exclusive control including but not limited to a delay or cancellation of a flight that causes you to miss any portion of the RMF Soccer Camp. We have no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at the camp locations. You are also responsible for respecting the authority and following the directions of the RMF Soccer Camp guide during a RMF Soccer Camp. We may exclude you from participating in all or any part of the RMF Soccer Camp if, in our sole discretion, your condition or behavior renders you unfit for the RMF Soccer Camp or unfit for continuation once the RMF Soccer Camp has begun. Unfitness may include, without limitation, any behavior that, regardless of its cause, is inappropriate or offensive or interferes with the delivery of RMF Soccer Camp services, or may constitute a hazard or embarrassment. In such case, our liability shall be strictly limited to a refund of the recoverable cost of any unused portion of the RMF Soccer Camp. Should you decide not to participate in certain parts of the RMF Soccer Camp or use certain goods included in the RMF Soccer Camp, no refunds will be made for those unused parts of the RMF Soccer Camp or goods. You agree to indemnify and hold us harmless from and against any costs, damages, losses, or liabilities arising out of your actions or omissions.<\/p><p><strong><u>General:<\/u><\/strong>\u00a0Any dispute related to the RMF Soccer Camp shall be governed by Canada law\u00a0without regard to conflict of laws principles. The federal or state courts in Quebec shall be the exclusive forum for any lawsuit related to the RMF Soccer Camp, and you consent to the personal jurisdiction by said courts. You agree to present any claims against us within 30 days after the RMF Soccer Camp ends and to file within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree to grant us (and third parties with whom we may engage in joint marketing) a worldwide, royalty-free, fully paid up license to use your photographic, video, or digital likeness solely for our promotional and\/or commercial purposes. Facsimile transmission of any signed document shall be deemed delivery of an original. At our request, you shall promptly provide an original document as well. If there are any conflicts between this Participant Agreement, the Reservation Form, and the Itinerary, this Participant Agreement shall apply.<\/p><p><strong><u>I<\/u><\/strong><em><strong><u>mage Rights<\/u><\/strong><\/em>: Since the right to images is regulated by article 18.1 of the Constitution, by Organic Law 1\/1982 on the right to honor, to personal and family privacy, and by the Organic Law 15\/1999 of Protection of Personal Data, Kaptiva Sports SL and related entities (Kaptiva Sports Inc.) ask for their consent to record the image of the child registered and publish it clearly identifiable, in the photographs and recordings corresponding to the activity of RMF Clinic and RMF Soccer Camp and which are exposed publicly in the different media used by Kaptiva Sports and its partners in order to disseminate the project and its social purposes.<\/p><p>This consent and authorization is granted free of charge and with formal renunciation of any economic consideration. We remind you that in order to exercise the rights of access, rectification, cancellation and opposition contemplated in the law you can communicate with Kaptiva Sports by writing to, Calle Arag\u00f3n 217, Pral, 2a, 08007 Barcelona, or by email at:\u00a0<a href=\"mailto:info@kaptivasports.com\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\">info@kaptivasports.com<\/a>. I declare that I have the legal powers to grant this authorization on the use of the image of the indicated minor.<\/p><p><strong><u>Special Provisions for Parent(s) or Guardian(s) of Campers<\/u><\/strong><\/p><p>I, the undersigned, as parent or guardian, give my consent for our camper, identified herein, to participate in soccer activities during the summer camp program. I understand that participation in any soccer event is done at our own risk. I will not hold\u00a0Kaptiva Sports Inc., its officers, agents, employees, or anyone acting in its behalf, responsible or liable for injury occurring to the named camper in the course of such activities or such travel.<\/p><p>I understand that Kaptiva Sports Inc. will complete required accident insurance forms, after which all claims under insurance policy, or policies, for injuries received while participating in the summer program activities and events, shall be processed by the camper, his\/her parent(s), or guardian(s) through the company handling the camper\u2019s insurance policy and not through Kaptiva Sports.<\/p><p>I hereby accept financial responsibility for personal items lost by the camper identified herein.<\/p><p>I authorize Kaptiva Sports to transport and to obtain, through a physician of its own choice, any emergency medical care that may become reasonably necessary for the camper in the course of such activities\/events or such travel. I also agree that the expenses for such transportation and treatment shall not be borne by Kaptiva Sports. I accept full responsibility and hereby grant permission for my son\/daughter to travel on any camp-related trip by bus or van.<\/p><p><strong>Communicable disease release of liability and assumption of risk agreement:<\/strong><\/p><p>In consideration of being allowed to participate in anyway in any Kaptiva Sports Inc. related events and activities I, the participant, parent, or legal guardian, acknowledge, appreciate, and agree that: By participating in Kaptiva Sports Inc. related events and activities, there are certain risks to me arising from or related to possible exposure to communicable diseases including, but not limited to, the virus \u201csevere acute respiratory syndrome coronavirus 2 (SARS-CoV-2)\u201d, which is responsible for the Coronavirus Disease (also known as COVID-19) and\/or any mutation or variation thereof(collectively ref erred to as \u201cCommunicable Diseases\u201d). I am fully aware of the hazards associated with such Communicable Diseases and knowingly and voluntarily assume full responsibility f or any and all risk of personal injury or other loss that I may sustain in connection with such Communicable Diseases.I, for myself or for my minor child(ren) or ward(s), and on behalf of my\/our heirs, assigns, beneficiaries, executors, administrators, personal representatives and next of kind, HEREBY EXPRESSLY RELEASE, HOLD HARMLESS,AND FOREVER DISCHARGE KAPTIVA SPORTS, INC. and its officers, officials, agents, representatives, employees, other participants, sponsors, advertisers, and, if applicable, owners and lessors of premises upon which \u00a0KAPTIVA SPORTS INC. related events and activities take place (the \u201cReleased Parties\u201d), from any and all claims, demands, suits, causes of action, losses, and liability of any kind whatsoever, whether in law or equity, arising out of or related to any ILLNESS, INJURY, DISABILITY,DEATH, OR OTHER DAMAGES incurred due to or in connection with any Communicable Diseases, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE, to the fullest extent permitted by law. I agree that this Agreement is intended to be as broad and inclusive as is permitted by the laws of the State of Florida, and if any portion hereof is held invalid, it is agreed that the remainder shall continue in full legal force and effect. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT,FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY ACCEPTING IT, AND ACCEPT IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.<\/p><p><strong>Weapons:<\/strong>\u00a0Students shall not carry or posses a firearm, knife, weapon, or an item which can be used as a weapon. Notice is hereby given that possession of a firearm, a knife, a weapon, or an item, which can be used as a weapon, is grounds for expulsion from the remaining of the summer program. Parent(s) or Guardian(s) will be immediately notified to pick up the camper. The fee paid for the summer program will not be reimbursed.<\/p><p><strong>Illegal Substances:<\/strong>\u00a0Notice is hereby given that possession or sale of controlled substances, as defined in Florida statutes, Chapter 893, by any camper is grounds for expulsion of the summer program. Student possession of or being under the influence of alcoholic beverages, and\/or hallucinogenic drugs or combinations of drugs or substances having hallucinatory effects, marijuana, or under the influence of glue or other drugs or combinations of drugs or drug paraphernalia expressly prohibited by federal, state, or local laws, including prohibited substances which shall include those substances possessed, sold, and\/or used that are held out to be, or represented to be, controlled substances, illegal substances, or counterfeit in any respect illegal or controlled substances is grounds for expulsion from the remaining of the summer program and referral to proper law enforcement agencies. Parent(s) or Guardian(s) will be immediately notified to pick up the camper. The fee paid for the summer program will not be reimbursed.<\/p><p>Further notice is hereby given that possession of prescription drugs, or any other over-the counter medication, not specifically ordered for the camper by a physician or the camper\u2019s parent or guardian is grounds for expulsion from the remaining of the summer program. Parent(s) or Guardian(s) will be immediately notified to pick up the camper. The fee paid for the summer program will not be reimbursed.<\/p><\/div>\n\t\t\t\t\t\t\t\t\t<div class=\"elementor-tab-title elementor-tab-mobile-title\" aria-selected=\"false\" data-tab=\"2\" role=\"tab\" tabindex=\"-1\" aria-controls=\"elementor-tab-content-1772\" aria-expanded=\"false\">FRAN\u00c7AIS<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-1772\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"2\" role=\"tabpanel\" aria-labelledby=\"elementor-tab-title-1772\" tabindex=\"0\" hidden=\"hidden\"><p><span style=\"text-decoration: underline;\"><strong>En signant ci-dessous, vous acceptez les termes et conditions suivants:<\/strong> <\/span>Kaptiva Sports Inc., une soci\u00e9t\u00e9 canadienne (\u00abnous\u00bb ou \u00abnos\u00bb) fournit les camps de soccer de la Fondation Real Madrid (le \u00abcamp de soccer RMF\u00bb) d\u00e9crits dans la brochure ci-jointe. Sauf indication expresse dans la brochure, vous \u00eates seul responsable de tous les frais li\u00e9s au camp de soccer RMF que vous engagez.<\/p><p><strong><u>Politique d\u2019annulation et de remboursement du client:<\/u><\/strong>\u00a0Si vous choisissez d\u2019annuler votre inscription, nous devons recevoir un avis \u00e9crit de ladite annulation soit par courrier certifi\u00e9, service de messagerie de nuit ou par courriel envoy\u00e9 \u00e0 info@rmfsoccercampscanada.com (avec confirmation de r\u00e9ception de notre part), et vous serez soumis aux frais d\u2019annulation suivants:<\/p><ul><li>Si nous recevons un avis \u00e9crit avant 60 jours de la date du camp, l\u2019organisation conservera 100,00 $ CAN \u00e0 titre de compensation pour les frais d\u2019inscription.<\/li><li>Si nous recevons un avis \u00e9crit entre 60 et 30 jours de la date du camp, l\u2019organisation conservera 50% des frais de paiement pay\u00e9s.<\/li><li>Si nous recevons un avis \u00e9crit d\u2019annulation dans les 30 jours suivant la date du camp, il n\u2019y aura aucun remboursement du montant pay\u00e9 pour les camps de soccer FRM.<\/li><li>Si le participant ne se pr\u00e9sente tout simplement pas au camp, il n\u2019y aura aucun remboursement pour le montant pay\u00e9.<\/li><\/ul><p><strong><u>Annulation ou substitution\u00a0<\/u>:<\/strong>\u00a0Nous pouvons annuler tout camp de soccer RMF \u00e0 tout moment pour quelque raison que ce soit, y compris sans limitation si nous estimons que le nombre de participants inscrits \u00e0 un camp de soccer RMF donn\u00e9 est insuffisant pour faire fonctionner ce camp de soccer RMF. Nous pouvons \u00e9galement changer l\u2019emplacement actuel en un emplacement diff\u00e9rent dans un rayon de 32 kilom\u00e8tres en raison de facteurs ind\u00e9pendants de notre volont\u00e9. Nous ferons des efforts commercialement raisonnables pour conserver le calendrier et l\u2019emplacement tels qu\u2019ils ont \u00e9t\u00e9 publi\u00e9s; cependant, le calendrier final peut varier en raison de facteurs ind\u00e9pendants de notre volont\u00e9. Nous pouvons, \u00e0 notre seule discr\u00e9tion, substituer des services ou des biens de qualit\u00e9 similaire \u00e0 tout service ou bien indiqu\u00e9 dans le calendrier. Si le camp de soccer RMF est annul\u00e9, notre responsabilit\u00e9 se limite au remboursement int\u00e9gral de vos acomptes et du prix du camp de soccer RMF, et nous ne serons pas responsables des autres frais, dommages ou remboursements de toute nature pour toute perte, retard, inconv\u00e9nient. , d\u00e9ception ou d\u00e9pense que ce soit dans de telles circonstances. Si, pour des raisons ind\u00e9pendantes de notre volont\u00e9, un camp de football RMF en cours doit \u00eatre interrompu ou annul\u00e9, nous envisagerons de bonne foi de rembourser une partie du prix du camp de soccer RMF en fonction de nos co\u00fbts r\u00e9els par rapport au camp de soccer RMF comme initialement envisag\u00e9.<\/p><p><strong><u>Certification de la sant\u00e9 des participants\u00a0<\/u>;<\/strong>\u00a0Responsabilit\u00e9 d\u2019informer l\u2019op\u00e9rateur des handicaps ou de la grossesse: En signant ci-dessous et \/ ou en nous soumettant une partie du prix du camp de soccer RMF, vous certifiez que vous ne souffrez d\u2019aucune condition ou handicap qui pourrait cr\u00e9er un danger pour vous ou pour les autres participants au camp de soccer de la RMF. Vous acceptez de nous informer par courrier certifi\u00e9 ou e-mail envoy\u00e9 \u00e0 info@rmfsoccercampscanada.com (avec confirmation de sa r\u00e9ception) au moment o\u00f9 vous effectuez votre premier paiement des frais de camp de soccer RMF (ou \u00e0 une date ult\u00e9rieure lorsque vous prendre conscience d\u2019une telle condition) de toute maladie physique ou mentale, invalidit\u00e9, grossesse ou toute autre condition pour laquelle vous pourriez avoir besoin de soins m\u00e9dicaux ou d\u2019un h\u00e9bergement sp\u00e9cial pendant le camp de soccer de la RMF.
