Real Madrid Soccer Experiences· Participant Agreement 

By registering to any of the Real Madrid Soccer Experiences of this website, you agree to the following terms and conditions: Kaptiva Sports Travel., a Spanish corporation (“we” or “us”) provides the Real Madrid Foundation Soccer Experiences (the “RMF Soccer Experience”) described in the accompanying brochure. These terms and conditions apply to the RMF Soccer Experience named on the Guest Reservation and Payment Form (the “RMF Soccer Experience”) and the program for this RMF Soccer Experience. 

Reservations: 

A completed deposit payment fee per participant, depending on the program chosen (except when otherwise noted in writing by us) and a completed Registration Form (“Registration Form”) are required with this Participant Agreement to reserve space for RMF Soccer Experience. All prices are in U.S. Dollars. Except as expressly stated in the brochure, you are solely responsible for any RMF Soccer Experience-related costs that you incur. 

Client Cancellation & Refund Policy: 

If you choose to cancel your registration, we must receive written notice of said cancellation either via e-mail sent to selected@rmfsoccercampscanada.com (with confirmation of receipt from us), and you shall be subject to the following cancellation fee: 

If we receive a written notice prior 60 days of the experience date, the organization will retain the deposit payment as a compensation for the registration-related expenses. 

If we receive a written notice between 60-30 days of the experience date, the organization will retain the deposit payment and the 50% of the balance payment paid. 

If we receive a written notice of cancelation within 30 days of the Experience date, there will be no refunds of the amount paid for the RMF Soccer Experiences. 

If the participant simply does not show up to the experience, there will be no refunds for the amount paid. 

Cancellation or Substitution: 

We may cancel any RMF Soccer experience at any time for any reason, including without limitation if we deem the number of participants signed up for a given RMF Soccer Experience to be insufficient to operate such RMF Soccer Experience. We will make commercially reasonable efforts to keep the schedule and location as it has been published; however, the final schedule may vary due to factors beyond our control. We may in our sole discretion substitute services or goods of similar quality for any service or good stated in the schedule. If the RMF Soccer Experience is cancelled, our liability is limited to a full refund of your deposits and RMF Soccer Experience price, and we will not be liable for any other costs, damages, or refunds of any kind for any loss, delay, inconvenience, disappointment, or expense whatsoever in such circumstances. If for reasons beyond our control, a RMF Soccer Experience in progress must be interrupted or cancelled, we will in good faith consider refunding a portion of the RMF Soccer Experience Price depending on our actual costs incurred compared to the RMF Soccer Experience as originally contemplated. 

Certification of Participant’s Health; 

Responsibility to Inform Operator of Disabilities or Pregnancy: By signing below and/or tendering any portion of the RMF Soccer experience Price to us, you certify that you do not have any condition or disability that would create a hazard for you or others participating in the RMF Soccer Experience. You agree to inform us via certified mail or e-mail sent to selected@rmfsoccercampscanada.com (with confirmation of receipt thereof from us) at the time you tender your first payment of the RMF Soccer Experience Fee (or at such later time when you become aware of such a condition) of any existing physical or mental illness, disability, pregnancy or any other condition for which you may require medical attention or special accommodation during the RMF Soccer Experience. We make no guarantee to be able to accommodate you for such condition during the RMF Soccer Experience, and we make no representations or warranties regarding special accommodations or handicap accessibility on the RMF Soccer Experience. 

Athletics Release: 

You hereby acknowledge that playing or practicing soccer is a potentially hazardous activity. You agree that you are voluntarily entering and assuming all risks associated with participating in those activities, including but not limited to falls, contacts with other participants, the effects of weather including heat and or humidity, and the conditions of the training grounds and facilities, all risks being understood and appreciated by you. Having read this waiver, and knowing these facts, and in consideration of Kaptiva Sports’ acceptance of this application, you hereby waive and release the Kaptiva Sports Travel. and its representatives from all claims and liabilities of any kind arising out of your participation in soccer playing, practicing, or training. 

Responsibility/Liabilities: 

We act only in the capacity of agent for providing services or goods in connection with the RMF Soccer experience (the Suppliers”), Experience operators, and providers of entertainment. We assume no responsibility for any personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be occasioned either by reason (1) any act or omission of any of the Suppliers (2) any matter beyond our exclusive control including but not limited to a delay or cancellation of a flight that causes you to miss any portion of the RMF Soccer Experience. We have no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at the Experience locations. You are also responsible for respecting the authority and following the directions of the RMF Soccer Experience guide during a RMF Soccer Experience. We may exclude you from participating in all or any part of the RMF Soccer Experience if, in our sole discretion, your condition or behaviour renders you unfit for the RMF Soccer Experience or unfit for continuation once the RMF Soccer Experience has begun. Unfitness may include, without limitation, any behaviour that, regardless of its cause, is inappropriate or offensive or interferes with the delivery of RMF Soccer Experience services, or may constitute a hazard or embarrassment. In such case, our liability shall be strictly limited to a refund of the recoverable cost of any unused portion of the RMF Soccer Experience. Should you decide not to participate in certain parts of the RMF Soccer Experience or use certain goods included in the RMF Soccer Experience, no refunds will be made for those unused parts of the RMF Soccer Experience or goods. You agree to indemnify and hold us harmless from and against any costs, damages, losses, or liabilities arising out of your actions or omissions. 

General: 

Any dispute related to the RMF Soccer Experience shall be governed by Spanish law without regard to conflict of laws principles. The federal or state courts in Barcelona, Spain shall be the exclusive forum for any lawsuit related to the RMF Soccer Experience, and you consent to the personal jurisdiction by said courts. You agree to present any claims against us within 30 days after the RMF Soccer Experience ends and to file within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree to grant us (and third parties with whom we may engage in joint marketing) a worldwide, royalty-free, fully paid up license to use your photographic, video, or digital likeness solely for our promotional and/or commercial purposes. Facsimile transmission of any signed document shall be deemed delivery of an original. At our request, you shall promptly provide an original document as well. If there are any conflicts between this Participant Agreement, the Reservation Form, and the Itinerary, this Participant Agreement shall apply. 

Image Rights: 

Since the right to images is regulated by article 18.1 of the Constitution, by Organic Law 1/1982 on the right to honor, to personal and family privacy, and by the Organic Law 15/1999 of Protection of Personal Data, Kaptiva Sports Travel SL and related entities ask for their consent to record the image of the child registered and publish it clearly identifiable, in the photographs and recordings corresponding to the activity of RMF Clinic and RMF Soccer Experience and which are exposed publicly in the different media used by Kaptiva Sports and its partners in order to disseminate the project and its social purposes. 

This consent and authorization is granted free of charge and with formal renunciation of any economic consideration. We remind you that in order to exercise the rights of access, rectification, cancellation and opposition contemplated in the law you can communicate with Kaptiva Sports Travel by writing to, Calle Aragón 217, Pral, 2a, 08007 Barcelona, or by email at: info@kaptivasports.com. I declare that I have the legal powers to grant this authorization on the use of the image of the indicated minor. 

Special Provisions for Parent(s) or Guardian(s) of Campers: 

I, the undersigned, as parent or guardian, give my consent for our camper, identified herein, to participate in soccer activities during the Experience program. I understand that participation in any soccer event is done at our own risk. I will not hold Kaptiva Sports Travel., its officers, agents, employees, or anyone acting in its behalf, responsible or liable for injury occurring to the named camper in the course of such activities or such travel. 

I understand that Kaptiva Sports Travel. will complete required accident insurance forms, after which all claims under insurance policy, or policies, for injuries received while participating in the Experience program activities and events, shall be processed by the camper, his/her parent(s), or guardian(s) through the company handling the camper’s insurance policy and not through Kaptiva Sports Travel. 

I hereby accept financial responsibility for personal items lost by the camper identified herein. 

I authorize Kaptiva Sports Travel to transport and to obtain, through a physician of its own choice, any emergency medical care that may become reasonably necessary for the camper in the course of such activities/events or such travel. I also agree that the expenses for such transportation and treatment shall not be borne by Kaptiva Sports Travel. I accept full responsibility and hereby grant permission for my son/daughter to travel on any Experience-related trip by bus or van. 

Communicable disease release of liability and assumption of risk agreement: 

In consideration of being allowed to participate in anyway in any Kaptiva Sports Travel. related events and activities I, the participant, parent, or legal guardian, acknowledge, appreciate, and agree that: By participating in Kaptiva Sports Travel. related events and activities, there are certain risks to me arising from or related to possible exposure to communicable diseases including, but not limited to, the virus “severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2)”, which is responsible for the Coronavirus Disease (also known as COVID-19) and/or any mutation or variation thereof(collectively ref erred to as “Communicable Diseases”). I am fully aware of the hazards associated with such Communicable Diseases and knowingly and voluntarily assume full responsibility f or any and all risk of personal injury or other loss that I may sustain in connection with such Communicable Diseases.I, for myself or for my minor child(ren) or ward(s), and on behalf of my/our heirs, assigns, beneficiaries, executors, administrators, personal representatives and next of kind, HEREBY EXPRESSLY RELEASE, HOLD HARMLESS,AND FOREVER DISCHARGE KAPTIVA SPORTS, TRAVEL. and its officers, officials, agents, representatives, employees, other participants, sponsors, advertisers, and, if applicable, owners and lessors of premises upon which  KAPTIVA SPORTS TRAVEL. related events and activities take place (the “Released Parties”), from any and all claims, demands, suits, causes of action, losses, and liability of any kind whatsoever, whether in law or equity, arising out of or related to any ILLNESS, INJURY, DISABILITY,DEATH, OR OTHER DAMAGES incurred due to or in connection with any Communicable Diseases, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE, to the fullest extent permitted by law. I agree that this Agreement is intended to be as broad and inclusive as is permitted by the laws of Spain, and if any portion hereof is held invalid, it is agreed that the remainder shall continue in full legal force and effect. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT,FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY ACCEPTING IT, AND ACCEPT IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. 

Weapons: 

Students shall not carry or posses a firearm, knife, weapon, or an item which can be used as a weapon. Notice is hereby given that possession of a firearm, a knife, a weapon, or an item, which can be used as a weapon, is grounds for expulsion from the remaining of the Experience program. Parent(s) or Guardian(s) will be immediately notified to pick up the camper. The fee paid for the Experience program will not be reimbursed. 

Illegal Substances: 

Notice is hereby given that possession or sale of controlled substances, as defined in Spanish statutes, by any camper is grounds for expulsion of the Experience program. Student possession of or being under the influence of alcoholic beverages, and/or hallucinogenic drugs or combinations of drugs or substances having hallucinatory effects, marijuana, or under the influence of glue or other drugs or combinations of drugs or drug paraphernalia expressly prohibited by federal, state, or local laws, including prohibited substances which shall include those substances possessed, sold, and/or used that are held out to be, or represented to be, controlled substances, illegal substances, or counterfeit in any respect illegal or controlled substances is grounds for expulsion from the remaining of the Experience program and referral to proper law enforcement agencies. Parent(s) or Guardian(s) will be immediately notified to pick up the camper. The fee paid for the Experience program will not be reimbursed. Further notice is hereby given that possession of prescription drugs, or any other over-the counter medication, not specifically ordered for the camper by a physician or the camper’s parent or guardian is grounds for expulsion from the remaining of the Experience program. Parent(s) or Guardian(s) will be immediately notified to pick up the camper. The fee paid for the Experience program will not be reimbursed.
